About the Abu Dhabi Judicial Department

Within the general plan to restructure the government of the Emirate of Abu Dhabi, whose features began to appear in 2006, the government was keen to work according to a coherent structure that provides world-class services to the public in all sectors, so that Abu Dhabi enters a new phase of construction to implement the ambitious vision of the emirate to gradually take its natural position on the world map. From this standpoint, His Highness Sheikh Khalifa bin Zayed Al Nahyan, President of the State, “may God protect him,” in his capacity as Ruler of the Emirate of Abu Dhabi, issued Law No. (23) of 2006 reorganizing the Judicial Department in the Emirate of Abu Dhabi. The emirate, its approach is the rule of law and work on the independence of those working to implement it. In this context, the law stipulates the establishment of a Judicial Council headed by the President of the Court of Cassation, which is concerned with examining all matters related to the appointment, promotion and secondment of judges in the Emirate of Abu Dhabi, in addition to the necessity of taking its opinion on draft laws related to the judiciary and the Public Prosecution.
The law also provided for the formation of courts of first instance, courts of appeal, and a court of cassation in the Emirate of Abu Dhabi. The courts of first instance are composed of civil and commercial departments, penal departments, administrative departments, and personal status departments, in addition to other departments that are formed based on the recommendation of the Judicial Council. The judiciary, and the law established a public prosecution for the Emirate of Abu Dhabi, headed by an Attorney General, and a sufficient number of members. While the law provided for the establishment of the Execution Department, which is concerned with the implementation of judicial rulings and handles judicial declarations. Another department called the “Judicial Inspection Department” was attached to the department, affiliated with the Judicial Council, and specialized in conducting periodic inspections of judges and members of the Public Prosecution office, and detecting any shortcomings in their performance of their duties. The law allocated an important chapter with regard to the immunity of judges, their duties and accountability. This chapter came to enhance the independence and integrity of the judiciary and ensure the transparency of the judge’s work within the limits that the judge does not exceed his impartiality in considering the cases brought before him, as the law gave in this chapter sufficient immunity to enable them to carry out their work without influence Which party they had in making their decisions, in addition to holding the judge accountable when he transgressed or fell short in managing his duties. Since its inception, the Department has developed its mission of adhering to the rule of law to preserve rights, freedoms, and community security, according to a vision that places excellence, effectiveness, and the provision of world-class justice services in the first place, preserving the values and independence of the judiciary, justice and integrity, customer service, commitment to excellence, and teamwork. The message of adhering to the rule of law in order to preserve rights, freedoms, and the security of society combines in communicating the efforts of the Judicial Department in its various judicial departments and divisions:• The Judicial Council, which consists of ten members who are senior advisors to the Judicial Department. They supervise all positions and tasks, and the selection, promotion and secondment of judges, in addition to other judicial technical affairs.• Administration of the Judicial Department, headed by the Undersecretary of the Judicial Department, who supervises the implementation of strategies, supporting administrative work, and all related matters.• The Public Prosecution Office, headed by the Public Prosecutor who supervises all technical and administrative tasks related to the Public Prosecution Office.
